The official Ensemble Stars!! Music team is deeply appreciative of the tremendous amount of fan work we have received. We wholeheartedly encourage fan creations made out of love and respect for the IP and acknowledge the legitimate rights of content creators. To cultivate a supportive and creative environment and address questions regarding fan work creation, we have outlined the following rules and regulations for your convenience.

 

I. Core Usage Principles of Ensemble Stars!! Music Intellectual Property

Ensemble Stars!! Music is exclusively owned by Happy Elements, which holds complete intellectual property rights. All rights to the Ensemble Stars!! Music game and its related materials (collectively referred to as "Ensemble Stars!! Music Intellectual Property") are non-transferable and non-shareable under any circumstances.

All individuals, including content creators, must adhere to the following principles when using materials (including but not limited to text, graphics, pictures, music, and videos) published by Ensemble Stars!! Music Intellectual Property, in accordance with the law:

1. You shall not infringe upon the rights and interests of Happy Elements and Ensemble Stars!! Music, nor harm the brand reputation of Ensemble Stars!! Music Intellectual Property. You must refrain from making inappropriate remarks about the brand image of Ensemble Stars!! Music.

2. You shall not register intellectual property rights or other rights for graphics, text, names, etc., related to Ensemble Stars!! Music IP in any country or region.

3. Fan works related to Ensemble Stars!! Music IP must not be used for commercial profit, political propositions, religious propaganda, ethnic discrimination, or other illegal purposes without mutual confirmation from both parties, including Happy Elements.

4. Derivative works based on Ensemble Stars!! Music IP fan creations must derive design elements solely from said fan works. Derivative works containing non-creative or low-design materials (illustrations, videos, audio, music, etc.) directly or indirectly copied or scanned from official Ensemble Stars!! Music IP materials will be deemed pirated products and are strictly forbidden.

 

II. Usage Principles of Official Ensemble Stars!! Music Intellectual Property Materials and Game Content on Social Media Platforms (YouTube, Facebook, Instagram, TikTok, Twitter, etc.)

The stories, plots, writings, music videos, concert videos, commemorative music videos, Dream Live, ES Music Garden, monthly magazines, etc. (collectively referred to as “IP content”) in the Ensemble Stars!! Music game and official IP materials are protected by copyright law. These elements play a crucial role in the operation of the IP and the game. Therefore, posting them on websites, social media, or other platforms (collectively, “Platforms”) for commercial purposes or inappropriate usage is strictly prohibited. Inappropriate uses include, but are not limited to:

1. Publishing core content or the entire game content directly in the form of videos, MVs, screenshots, text transcriptions, translations, videos, collections, etc., on various platforms beyond a reasonable amount.

2. Publicly releasing parts or the entirety of the game content on various platforms in a manner that clearly exceeds purposes of personal research or appreciation.

3. Reprinting or processing any portion of the content (including but not limited to MVs, PVs, programs, cards, CGs, etc.) officially released by Ensemble Stars!! Music Intellectual Property on various platforms.

4. Other publishing or sharing behaviors that exceed reasonable scope and substantially replace the core content of the game (including but not limited to significant or entire content from special performances, 3D clothing and its SCR, room clothing and its SCR, voice lines, office interaction, etc.).

5. Using game content to conduct acts that violate laws and regulations, social morality, or public order, or harm the legitimate rights and interests of any third party.

6. Other actions that may negatively affect the game.

These regulations not only protect the varied creative contents within the game but also ensure that more people can enjoy the game content in a better way. We sincerely appreciate your support and cooperation.

 

III. Principles of Small-Scale Fan Creation for Profit

“Small-scale fan Creation for Profit” refers to the sale of derivative products based on fan creations by fan creators, with limited production capacity and sales volume, where the primary purpose is not profit.

The following situations are provided for your reference:

1. If the total production value of derivative works sold online and offline (calculated by "retail prices * production quantity") does not exceed any of the amounts specified below, no declaration is required to the official Ensemble Stars!! Music team:

(a). The total production value of the derivative work, including any or all current and future Ensemble Stars characters, does not exceed 850 USD.

* Products with minor or non-essential detail changes are not considered new products; hence, their production values should be accumulated.

(b). The production value of all monthly derivative work sales by the same creator/organization does not exceed 850 USD.

* If a creator/organization is involved in multiple projects/events, the total production value of all monthly sales across all projects/events should not exceed 850 USD.

* Please note that the total production value applies to all sales events combined in one month rather than a single sales event.

* The monthly total production value mentioned above is for a calendar month, and any balance shall not be carried forward to the next month. For instance, the maximum total production value for November 2021 is 850 USD, and it is also 850 USD for December 2021.

* This includes both online and offline marketplace sales.

(c). The total production value of continuous product replenishment must satisfy both conditions (a) and (b).

* If the accumulated total production value of product replenishment exceeds the requirements specified in (a) or (b), it may be considered mass production.

Please declare your sales and obtain permission from the official Ensemble Stars!! Music team in advance if your combined online and offline sales reach or exceed the limits of any situations listed above. You can contact us at happyplus_license@happyelements.com.

2. Make-to-order productions (including but not limited to any production and/or sales for unspecified objects or unspecified production quantities through pre-sale, crowdfunding, reservation, etc.) are strictly forbidden.

* Providing picture materials for customers to choose from before production is considered a violation.

* Uploading picture materials on any platform/website (including but not limited to file hosting services, e-commerce material websites, etc.) for customers to download and print is considered a violation.

3. It is prohibited to charge for reading, downloading, or recreating already published fan works or accept commissions for fan work creation, regardless of the amount.

4. Food, cosmetics, health care products, and other product categories involving food hygiene and safety issues will not be authorized for production and sale, regardless of the value of such derivative products.

5. Any production or sales that violate the regulations mentioned above shall be considered an infringement act. The official Ensemble Stars!! Music team will seek legal rights protection.

 

IV. Legal Liability for Violations of the Code

Any behavior that violates this code, other laws, or regulations, infringes on the legitimate rights and interests of third parties, or causes any adverse consequences, the responsible party—rather than Happy Elements or the Ensemble Stars!! Music brand—shall take full responsibility. For any act that severely impairs the brand image of Happy Elements and Ensemble Stars!! Music, Happy Elements reserves the right to request the responsible party to remove the work, apologize, eliminate any negative impact, and compensate for losses. Happy Elements also reserves the right to pursue accountability through legal means.
